Islamabad: Islamabad High Court (IHC) is facing another dispute, which is due to differences between acting chief Sardar Muhammad Sarafraj Dogar and Justice Babur Sattar between the differences between the case transfer issue, Reports Informed on Saturday.
The administrative order issued by the Acting Chief Justice stated that Justice Sattar has resumed himself after hearing the case. The Acting Chief Justice has issued an administrative order to the bench of Nyaya Sattar to hear the case.
Meanwhile, Justice Sattar has issued a judicial order, questioning the powers of the Acting Chief Justice and directed the deputy registrar to re -fix the case before a new bench.
In his order, Justice Sattar noticed that on March 14, the case was sent back to hand it to another bench; However, perhaps by mistake, the case file has been sent again to this court, and the file was sent with a comment on the Chief Justice’s administrative side that he would listen to the case of the same bench.
Justice Sattar wrote in this order that sending the case back to court may be an unknown error from the Chief Justice’s office or the employees of the registrar.
It was observed in the order that the CJ has no right to decide whether the court should listen to any case. According to the rules, the concerned judge has the right to resume itself by listening to a case when it is determined before a bench.
The order further stated that there was no place to intervene in the position of a judge from the hearing of a case for the office of the Chief Justice or Registrar’s office.
According to the rules, the deputy registrar has the right to schedule emergency and general matters for hearing. The responsibility of the Chief Justice is to approve the roster of benches prepared by the Deputy Registrar.
The court of Justice Sattar said that after approving the roster, there is no role in schedule of every case filed by the Chief Justice. The judge noticed that if the bench hearing a case and asked himself to re -introduce himself or asked to build a large bench, the matter would go to the Chief Justice.
Sending a case to the Chief Justice after a bench is not according to the practice rules before listening to yourself. After a bench, the matter should be sent to the deputy registrar to send it to another bench.
