New Delhi: Google has selected a compromise with India’s Competition Commission (CCI) and for payment of fine of Rs 20.2 crore in Android TV issue, where the Fairplay regulator found a prima facial case of misuse of the major condition by the Global Tech Giants.
It follows the two punishments that CCI had slapped on Google earlier, its play store policies and its dominance in the Android operating system.
In the TV case, Google filed a settlement application under Section 48A of the Competition Act, consenting for a ‘New India Agreement’, under which it would provide a standalone license for Play Store and Play Services for Android Smart TV in India. The CCI stated that it would remove the need to bundle these services or implement the terms of default placement. Additionally, by waiving the requirement of a valid Android Compatibility Commitment (ACC) for shipped equipment in India, which does not include Google Apps, TV companies can now sell and develop uncomfortable Android devices without violating Google’s television app distribution agreement (TADA). “… Considering the impact of nature, gravity and contraception, considering the assessment of content and disposal proposal on records, the Commission agrees to proposal to settle in the context of Section 48A (3) of the Act and settlement rules.Final settlement amount, after implementing the settlement exemption of 15%, is Rs 20.2 crore, “CCI said. The essence of the charge was that Google misused its main condition by implementing restrictive agreements on TV manufacturers.
