When the attack took place, James was rented a room in Dick’s house, which was about 10 miles north of Orlando. Nyunar and three other children were at home at night of deadly attacks, although the other three children were not damaged.
Before he returned to his room at home, the court records revealed that James drank 24 beer and some liquor, and took LSD.
Nyunar was raped and killed, while Dick was stabbed 21 times. After killing them, James stole the woman’s jewelry and her car, then went across the country to Bakersfield, California, where she was arrested on 6 October 1993.
James accepted both crimes during a videotap confession with the police.

Several appeals argued that James had cognitive issues that he should be saved from execution, filed with state and federal courts, but all were rejected.
Earlier this month, the Florida Supreme Court rejected an argument from James’ lawyers that their long use of drug and alcohol combined with head injuries and a heart attack in 2023 due to a “mental decline” due to a heart attack, which would lead to execution cruel and unusual punishment.

In the refusal, the judges agreed with the decision of the lower court, stating that cognitive issues did not leave James from his death sentence. James’ lawyers also attempted to argue that the heart attack he had experienced in jail was lacking oxygen, affecting his brain, which should have been the basis for preventing execution plans, but the court also refused.

The execution of James marked the second to be held in the state of Sunshine this year, as James Ford was killed in February 1997 in front of his child daughter to kill a Charlett County couple, who survived.
