    The Federal Shariat Court (FSC) has ruled on unequal practice of Chadar and Perchi-who denies the right to inheritance to women-ensure greater security of women’s property rights in Pakistan, along with the nation, illegally, illegally, in Pakistan.

    The court said that customs such as Chadar and Perchi go against the rights given to women in Quran and Sunnah. Forcing women to give up their legacy under social pressure, this verdict is a violation of both Islamic teachings and laws.

    The court ordered action against the violations under Section 498 and emphasized the need for awareness campaigns to protect women’s rights and strict enforcement of heritage laws.

    During the hearing, it was discovered that the chaddar and parachi traditions are practiced in Bannu. However, the Khyber Pakhtunkhwa government denied the existence or importance of such customs.

    The court ruled: “However, the petition is partially accepted, from which the petitioner is demanding relief to declare a local custom, which according to him is prevalent in district Bannu, KP with the name of Chadar or Piresi, and women of that region are being denied their rights to their ancestors. With any other name, there is no legal force in the form of un-Islamic and illegal, on the basis of which there is no legal force, which is completely or partially deprived of their ancestor property, which is inherited by their rights, which is deprived of their rights.

    “We further declare that all or any such custom or use, which in any way affects the rights of women’s legacy, no matter what it is, the name by which it is called or known in any area of ​​the country, is, it is, Islamic and illegal and action for such criminals, which is a state of fails. The state is an important duty.

    According to Transparency International, even in cases where women have legal rights on paper – such as in Pakistan – reality is often quite different. Systemic corruption and discrimination often obstruct women to exercise their rights and claim their proper part in society, calling rights groups.
