JC Furman, District Judge of the US District Court for the southern district of New York, has been slated to hear Khalil’s case, at around 11:30 pm his lawyers claimed that snow has violated Khalil’s constitutional rights and is also requesting his return to New York.
Furman has the power to order Khalil’s release, but it is not clear that he will do so. Furman has ordered that the 30 -year -old man should not be deported, while the court considers the legal challenge brought by its lawyers.
Khalil’s wife, an American citizen, is currently eight months pregnant, according to her lawyer.

Khalil, who works as a spokesperson of Columbia protesters, is not accused of crime, although the hearing may provide more information about the circumstances that motivate them to arrest and detain the government’s justification.
Their lawyers and civil rights groups argue that the government is illegally taking vengeance against them for their speech and unconstitutionally to prevent them from speaking out using their immigration-control powers. Prior to Wednesday’s hearing, a joint filing for Khalil’s lawyers and the government states that the government has intended to argue that New York’s Southern district is not a proper site for the case.
Khalil met his requirements for Columbia Master’s degree in December. Born in Syria, he is the grandson of Palestinians who were forced to leave their motherland, their lawyers said in a legal filing.
According to CNN, Khalil played a major role in protests against Israel against Israel, which shook Columbia University last year and met university officials as Columbia University, which a group of student groups urged the university to divide from Israel.

White House press secretary Karolin Lewit defended the decision of the Trump administration to arrest Khalil and claimed that he distributed Pro-Hamas Publicity Flyer on the campus.
Levit told reporters on Tuesday at a press briefing in the White House, “This administration is not going to tolerate people who have killed Americans,” this administration is not to study in our country and then to side with terrorist organizations. “We have a zero-optional policy for siding with a period of terrorists.”
According to The New York Times, the future of Khalil’s immigration status will be fixed in a separate process. The case will be chaired by an immigration judge, which can determine whether to cancel Khalil’s green card.

Meanwhile, ABC News reports that Khalil’s wife claims that her husband “begged” from Columbia University for legal support in an email a day before her arrest, but the university never responded.
He said, “I am not able to sleep, with fear that snow or a dangerous person may come to my house. I need immediate legal support and I urge you to intervene,” he allegedly said in his email.
She also claims that she was threatened with arrest when she refused to leave her husband with agents during her apprehension, claiming that the couple had never shown warrant according to the outlet.
